Passion Maps Terms and Conditions

I agree:

that benefit derived from my Passion Mapping Course depends upon the extent of my participation;
to participate fully in my Passion Mapping sessions and provide feedback to my coach following the sessions;
that Passion Maps Pty Ltd, its coaches, representatives or agents cannot guarantee any outcome or result arising from my Course
not to hold Passion Maps Pty Ltd, its coaches, representatives or agents responsible for any actions I take or outcomes arising as a result of my Passion Mapping Course;
not to hold Passion Maps Pty Ltd, its coaches, representatives or agents, nor to any other third party, for any loss costs or damage, expenses or other claims for compensation of any kind whatsoever arising directly or indirectly from my Passion Mapping Course;
not to copy, publish, or distribute the content of my Passion Mapping session to anyone;
not to use the name of Passion Maps, or any of the content of my Course for any other process, program, training, workshop or event nor to attempt to demonstrate or instruct others in any of the techniques used in the Passion Mapping Course until such time as I have received official training in how to become a coach from Passion Maps Pty Ltd;
to give consent to Passion Maps Pty Ltd to use my personal information entered on this application form for the use of completing my Passion Mapping Course provided that Passion Maps Pty Ltd will keep all such information confidential and use it for the purpose of follow up and not for distribution or publication;
to give permission to record or take pictures, videos and audio materials in connection with the course and authorise the use of these materials for archival, educational, promotion, advertising or other purposes that support the mission of Passion Maps.

1. Passion MapsTM Pty Ltd (The Company) is committed to the protection of your privacy. It will not sell, exchange or otherwise divulge personal information about you to third parties apart from its Accredited Practitioners and service providers without your written consent or if required by law.

2. When personal information is provided to The Company, either on paper or electronically, it is used:

a. to answer your queries and facilitate your participation in our programs; or

b. to gather feedback in relation to the effectiveness of our Accredited Practitioners; or

c. for research purposes aggregated in such a way that individual characteristics cannot be identified; or

d. to provide information to you about our programs and services.

3. The Company will not ask you for information it does not need or will not use. Without the information The Company collects about you, The Company’s ability to provide you with information, and to perform the tasks identified above, would be affected.

4. Your personal information may be viewed on written request to The Company. The Company reserves the right to charge an administrative fee for this service. Under exceptional circumstances permitted by law, Passion Maps may deny access to this information, for example, if it is the subject of a legal investigation or
if its release would harm the life or security of an individual.

5. Changes to your personal information may be made on the website, in writing to The Company, or on verbal request to The Company.

6. The Company takes all reasonable steps to ensure the confidentiality of your information when it is transmitted to Passion Maps via information technology. The Company does not accept liability for the confidentiality of personal information provided by individuals to other third parties.

7. All personal information collected through the Passion Map website is protected by a secure server.

8. Cookies may be used to identify you when you login to the Passion Maps website. The cookies do not contain personal information about you but may hold information about your preferences on the website.

Provisional Passion Mapping Coach Agreement

Nature of Agreement:

To assist in defining the roles. This agreement covers all accreditation courses.

Glossary

Accredited - completed training, qualifying client courses and received Passion Mapping Coach Accreditation.
Active accredited coach - Accredited coach who has facilitated a Passion Mapping Course within the previous year.
Coach - Accredited Passion Mapping Coach
Course/s - Inclusive of all Passion Mapping courses and programs
Inactive coach - a coach who has not facilitated a Passion Mapping course with a client within the previous year.
Passion Mapping Materials - Passion Map, discs and including any Passion Maps branded materials.
Qualifying coach - a coach in training who is facilitating qualifying mapping courses with clients.
Reactivating coach - a coach who has previously been an accredited coach and currently reactivating accreditation by undergoing Passion Mapping coach training.

1.0 Responsibilities of The Company

1.1 To provide the coach with the most up-to-date documents.

1.2 To provide a pathway for the further professional development of coaches.

1.3 To provide coaching, mentoring support and advice to coaches for their professional Practice.

1.4 To maintain complete confidentiality clients of an accredited coach.

1.5 To provide materials and training required for Coaches to complete and maintain their accreditation status, and for them to facilitate the courses in which they are accredited. To provide materials required, at the coach’s expense - prices available on the website.

2.0 The Company Entitlements

2.1 To request information from coaches to confirm activity status of Courses.

2.2 The Company reserves the right to remove a coach’s accreditation if in its judgment a coach is not practicing Passion Mapping in a professional or ethical manner and is in any way breaching the terms and conditions of this agreement.

2.3 To request information from coaches for the purpose of quality control.

3.0 Coach Accreditation Requirements

3.1 To follow, at all times, the coach accreditation requirements as stated in this Coach Agreement and/or agreed between the coach and The Company.

3.2 Accreditation remains active providing a minimum of two courses have been facilitated annually.

4.0 Coach Entitlements

4.10 A qualifying coach is entitled:

4.11 To facilitate only the Passion Mapping Courses for which they are qualifying.

4.12 To promote themselves only as a Qualifying Passion Mapping coach.

4.13 To receive and access coach resources as provided by The Company.

4.14 To purchase Passion Mapping Kit materials from The Company for facilitating qualifying courses.

4.15 To enable clients to enroll online for a Qualifying Passion Mapping Course.

4.1 An active accredited coach is entitled:

4.21 A coach is entitled to enter into a collaborative development agreement with The Company for developing new offerings.

4.22 To facilitate only the Passion Mapping Courses for which they are accredited and active.

4.23 To receive and access coach resources as provided by The Company.

4.24 To receive regular updates from The Company.

4.25 To enter into a financial agreement with The Company to receive and refer clients.

4.26 To enter into an agreement as a contractor to The Company.

4.27 To purchase Passion Mapping Kit materials from The Company for facilitating courses accredited and active in.

4.28 To enable clients to enroll online for a Passion Mapping course.

4.2 An inactive coach is entitled:

4.31 To undertake a reactivation course provided by The Company.

4.32 To facilitate only the Passion Mapping courses for which they have been accredited.

4.33 To receive and access coach resources as provided by The Company.

4.34 To receive regular updates as provided by The Company.

4.35 To purchase Passion Mapping Kit materials from The Company for facilitating reactivation courses.

4.3 A reactivating coach is entitled:

4.41 To facilitate only Passion Mapping Courses for which they are reactivating.

4.42 To receive and access coach resources as provided by The Company.

4.43 To receive coach updates from The Company.

4.44 To enter into an agreement with The Company to receive and refer clients.

4.45 To purchase Passion Mapping Kit materials from The Company for facilitating reactivation courses.

5.0 Coach Responsibilities

5.1 To facilitate Passion Mapping courses to the highest standards of competence and professional conduct at all times.

5.2 To facilitate only the Courses for which they are qualifying, reactivating or actively accredited.

5.3 To use only the latest versions of Passion Mapping materials and processes.

5.4 To provide or utilise an appropriate venue for clients to undertake a Passion Mapping course to achieve the best outcome.

5.5 To use Passion Mapping processes as outlined in the coach manual and training courses; and not deviate, change or in any other way alter the core Passion Mapping process without the prior consent in writing from The Company.

5.6 To inform The Company immediately of any practice observed that could be detrimental to the reputation of The Company or bring it into disrepute.

5.7 To ensure all Passion Mapping clients online registration is completed either by the coach or client.

6.0 Ownership and Use of Passion Mapping materials

The Applicant and/or Coach acknowledges and agrees:

a) That all Intellectual Property Rights in the Materials are the sole property of The Company;

b) To cooperate with The Company to safeguard and not to violate The Company’s Intellectual Property Rights; and;

c) To inform The Company of any actual or threatened infringement of Passion Maps Intellectual Property Rights immediately upon becoming aware.

d) Unless a requirement of online courses, not duplicate, photocopy, reproduce, rent, translate, sub-license or alter the Materials that would be inconsistent with The Company’s exclusive ownership of the Materials.

e) To only use the Passion Mapping Materials provided by The Company for the purposes of participating in Courses and for no other purpose without the prior written consent of The Company.

f) To not use the name of Passion Maps, or any of the Materials for any other process, course, training, workshop or event other than as part of the Course without the prior written consent of The Company.

g) To not use Passion Maps trademark, logo, device, set up or other branding materials without the prior written consent of The Company.

h) To not remove any copyright or trademark notice, statement or mark of Passion Maps in the Materials; and

i) To not attempt to license, assign, or otherwise deal in any rights in or to the Materials or any of Passion Map’s Intellectual Property Rights without the prior written consent of the Company.

j) To treat the coach manual/s as a confidential document and not disclose the contents without the prior written consent of Passion Maps Pty Ltd

Governing Laws and Jurisdiction

This agreement is governed by the laws of New South Wales in the Commonwealth of Australia. You agree to submit to the nonexclusive jurisdiction of the Courts of that State irrespective of any conflict of laws principles. If any provision of this agreement is unenforceable, this shall not invalidate the remaining provisions of this agreement.

7.0 As an applicant and/or Coach:

a) I acknowledge that accreditation requires the successful completion of the training process, including completion of qualifying Passion Mapping Courses within the agreed time.

b) I acknowledge if I do not complete facilitation of qualifying Passion Mapping Courses within the required time additional fees will be charged.

c) I acknowledge that any benefits derived from Passion Mapping Accreditation Courses depend upon the extent of my participation. Any concerns that I have regarding my accreditation will be directly communicated with The Company.

d) I understand that I may not facilitate any Passion Mapping Courses that I have not undertaken official training in provided by The Company.

e) I acknowledge and agree that to maintain my accreditation status I must meet The Company’s minimum activity requirements per calendar year.

f) I understand that as a coach I represent myself or my business and not The Company.

g) I will not attempt to demonstrate or train others in Passion Mapping techniques until such time I have received official training and permission to do so from The Company.

h) As a condition of accreditation, I agree to abide by the Code of Ethics of the International Association of Facilitators (IAF).

i) I indemnify The Company and against any or all liability, loss or damage or costs made against or incurred or suffered by The Company or indirectly arising out of breach of this agreement. (Coaches may wish to provide their own Professional Indemnity Insurance at their own expense.)

j) That should my accreditation be revoked due to breach of this agreement; I will immediately cease facilitating Passion Mapping Courses and return all and any Passion Mapping materials in my possession to The Company without any compensation to be provided by The Company. The decision to revoke a coach’s accreditation will be made by a panel of coaches representing The Company in their absolute discretion.

k) Should I not successfully complete the Accreditation Process, within three months, I further agree to relinquish my rights to use the Passion Maps process and Intellectual Property and will not represent myself as an Accredited Coach. I agree to return all Materials to The Company within 30 days at my own cost.

l) I understand that to continue as a Passion Mapping Coach I will be required to renew my agreement annually. At such time, The Company will also inform me of any changes made to this agreement. Should I not wish to renew my agreement, I agree to cease as a coach of Passion Mapping Programs.

m) I understand that the following provisions of this agreement survive termination; clauses 6(a) 6(b) 6(c) 6(d) 6(e) 6(f) 6(g) 6(h) 6(i) 7(j) 7(k)

Cancellation Policy

I understand and willingly agree that in the event of my cancellation of the course, the following conditions will apply:

In the event of cancellation up to 3 months prior to the starting time of the event a fee will apply of $100.
In the event of cancellation of less than 90 days prior to the starting time of the event and no less than 30 days, a cancellation fee will apply of 25% of the full program fee.
In the event of cancellation of less than 30 days and no less than 7 days, a cancellation fee will apply of 50% of the full program fee.
In the event of cancellation less than 7 days prior to the starting time of the event, there will be no entitlement to a refund.
Passion Maps will consider special circumstances when considering requests for a more favourable refund.
